Welcome to Alma ("Service"), a chatbot builder platform operated by Hunter Creative Media & Design ("Company," "we," "us," or "our"). By accessing or using Alma, you agree to be bound by these Terms of Service ("Terms").

1. Acceptance of Terms

By creating an account, subscribing to a plan, or using any part of the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

Alma is a software-as-a-service platform that allows users to create, customize, and deploy AI-powered chatbots for their websites and messaging platforms. The Service includes:

  • Chatbot creation and customization tools
  • Website widget deployment
  • Integration with third-party messaging platforms (where available)
  • Analytics and conversation management
  • White Glove setup services (sold separately)

3. Account Registration

To use Alma, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access

You are responsible for all activity that occurs under your account.

4. Subscription Plans and Billing

4.1 Plans and Pricing

Alma offers multiple subscription tiers (Starter, Growth, Agency) with monthly and annual billing options. Current pricing is available on our website. We reserve the right to change pricing with 30 days' notice to existing subscribers.

4.2 Free Trial

New accounts may receive a 14-day free trial. A valid payment method is required to start a trial. You will be charged automatically at the end of the trial period unless you cancel.

4.3 Billing

  • Subscriptions are billed in advance on a recurring basis (monthly or annually)
  • All fees are non-refundable except as stated in our Refund Policy
  • You authorize us to charge your payment method for all fees incurred

4.4 Cancellation

You may cancel your subscription at any time through the Stripe customer portal. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial periods.

5. Acceptable Use

You agree NOT to use Alma to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit spam, malware, or harmful content
  • Harass, abuse, or harm others
  • Collect personal data without proper consent
  • Impersonate any person or entity
  • Interfere with or disrupt the Service
  • Create bots that provide medical, legal, or financial advice without appropriate disclaimers
  • Engage in any fraudulent or deceptive practices

We reserve the right to suspend or terminate accounts that violate these terms.

6. Intellectual Property

6.1 Our Property

Alma, including its software, design, features, and documentation, is owned by Hunter Creative Media & Design and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service.

6.2 Your Content

You retain ownership of the content you create using Alma, including bot configurations, conversation flows, and customizations. By using the Service, you grant us a license to host, store, and display your content as necessary to provide the Service.

7. Data and Privacy

Your use of Alma is also governed by our Privacy Policy. You are responsible for ensuring your use of Alma complies with applicable data protection laws, including obtaining necessary consents from your end users.

8. Third-Party Integrations

Alma may integrate with third-party services (Meta/Facebook, messaging platforms, etc.). Your use of these integrations is subject to the respective third party's terms and policies. We are not responsible for third-party services.

9. White Glove Services

White Glove setup services (Basic and Premium) are one-time purchases subject to these additional terms:

  • Services are delivered within 5-7 business days of purchase
  • Premium includes one 30-minute training call, to be scheduled within 30 days
  • Additional revisions beyond the scope may incur additional fees

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUNTER CREATIVE MEDIA & DESIGN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Hunter Creative Media & Design, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

14. Termination

We may suspend or terminate your access to Alma at any time for violation of these Terms or for any other reason with notice. Upon termination, your right to use the Service ceases immediately.

15. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in DuPage County, Illinois.
